Papers relating to the action of assault and batter, Theophilus Anthony v.
John Franklin. Jay is the attorney for John Franklin who is accused by T. Anthony of
assaulting and beating him on the New York dock. The assault occurred after a dispute
over the defendant's use of a wharf in which the plaintiff was interested. Franklin also
accused of abusing Anthony verbally. Anthony at first refused to fight but after pushing
Franklin, he was beaten unmercifully. Franklin maintained that the case should be
dropped because it was a case of self-defense. The suit was for 500 pounds. The trial
was held 1 April 1775 with John T. Kempe attorney for Anthony.
