- Abstract
- Encloses paper drawn up by Scott and Dr. John Nicholl concerning general principles of proceeding in prize cases in British Vice-Admiralty courts. Enclosure: signed by Scott and Nicholl, d. 10 September 1794. Sets forth general principles of proceedings in such cases as set forth in report made in 1753 by Sir George Lee, et al. Measures which ought to be taken by captor and neutral claimant upon sh ip and cargo brought in as a prize. Method of appealing decisions. Degree of proof demanded of appellant. As for recent captures at Martinique, believe that condemnations there must be tried by the High Court of Admiralty in England as there are no legal courts of Admiralty in Martinique.
