Abstract:
Question on the allocation of fees in two cases of ejectment brought before the Supreme Court of Judicature. The same witnesses and surveys were required in each case. The Chief Justice has asked Jay and six other "Practisers" to give their opinion on whether the fees involved should all be charged to the defendant in the first case tried, or divided between the two defendants, or to be charged in full to both. Jay and his colleagues agree that the cases should be considered "as entirely distinct, & that the Costs be taxed accordingly." Document signed by Jay, Robert R.
