Thomas Olive, Daniel Willes, John Penford, Joseph Helmsly, Robert Stacy and Benjamin Scott, having arrived at Sandy Hook with about two hundred persons to settle in West Jersey to the east of the Delaware River or Bay, claimed the authority of proprietors in those parts, for which they produced indentures from the Duke of York to John Lord Berkeley and Sir George Carteret dated 23 and 24 June 1664; other indentures and deeds of 18 March 1673; 9 and 10 February 1674 from John Lord Berkeley to John Fenwick for a moiety of New Jersey; from John Fenwick and Edward Billing to William Penn et al., and a commission dated 4 April 1677 from William Penn et al. to Thomas Olive et al. According to his Majesty's Patents of 24 August 1674, it appears that these lands have continued in the possession of the Governor. However, in consideration of the large number of people still onboard the Kent anchored off Sandy Hook, it is resolved that they may land and proceed to Delaware to settle on any land duly purchased; provided that they should submit to the governor in all things as the rest of his Majesty's subjects until they receive sufficient authority for his discharge.
