- Letterbook copy. Resolution of the Committee of the whole: 1) that clause ordering Jay to stipulate the right of the U.S. to its territorial bounds and the free navigation of the Mississippi be declared void; 2) Jay can relinquish the navigation of the Mississippi for a limited period of time. No stipulation that Spain has exclusive right to the navigation of the Mississippi below 31 degrees unless the rest of the river is declared free to the navigation of both countries. The boundary between the U.S. and the American territories of Spain must be that of the definitive treaty between the U.S. and Britain. Jay authorized to appoint commission to settle any difference on this question. King amendment: Jay can sign no treaty unless the boundaries of the definitive treaty are recognized. This amendment lost. Motion to postpone the first resolution in order to consider the repeal of Jay's commission to treat. It was voted not to postpone discussion for this purpose.
