- Jay's remarks on the negotiation with Gardoqui: the commission fine except the requirement that Jay tell Congress every proposition he may wish to make to Gardoqui and every one which Gardoqui may make to him. Jay does not want to conclude anything without the consent of Congress. Impossible to do business under this instruction. It will make Gardoqui too circumspect, and will be apt to disgust the Spain court. Jay not optimistic about the negotiation anyway and it is hoped that it can at least be carried on without irritation. However, Jay willing to follow the instructions of Congress.
