- Summary
- Opinion on case against Mr Blair McClenachan brought to the court of King's bench in England by J. Brag. Not consistent with peace treaty or even laws governing war, but probably will do no more than inconvenience the defendant. Should be seen in terms of New York law passed on March 17th, 1783 enabling those who abandoned property during the war to bring suit against those who subsequently occupied them or acquired their goods or property. Favorable construction by mayor's court of New York, but still pending in state courts and assembly. Thinks this law contrary to laws of nations and peace treaty; the case in England perhaps prompted by the example of the New York law.
