- The Commissioners should agree upon those elements of interest which would exclude the third member of the commission. They should mutually agree upon the third party, and if the British commissioner insists upon appointing the man, the American commissioner should refuse to proceed and provide facts for a representation to the British court. The nature of the transaction should be such that two out of the three Commissioners agreeing, their decision will be binding.
