- "Note" on reverse of paper in Washington's Hand: "The enclosed Papers [documents , 10603 and 10605 and 1066] were never acted upon--unless the Sentiments in that marked A were communicated by Mr. Jay at the President's request to the Encargado of Spain Mr. Gardoqui." This manuscript is a draft in Jay's hand of a proposed letter from Washington to the Senate informing the Senate) informs Senate that Gardoqui is returning to Spain. Suggests that if Senate wishes negotiations for Spanish treaty to be carried on as instructed by Confederation government, agreement can probably be reached before Gardoqui's departure. Jay feels that no unnecessary delays should occur. "In my opinion it is expedient that nothing which may pass on this Subject in your Body, should at least for the present transpire, that in Case the negociations should not proceed the public mind may not be unnecessarily agitated. "Postscript in Jay's hand concerning this last point: "This latter point however proper, is capable being improperly used, tho' I do not think it probable." Gardoqui informed Jay of his planned departure from New York in a note of July 24.
