Summary
Encloses letter from Floridablanca. If men were American citizens, right not to give them up, even as deserters from Spanish service. If Spanish, then subject of the Spanish king. If foreigners, have right to enter into whichever service they want; if previously engaged to enter into Spanish service, the enlistment on the American ship is void, because friendly to Spain. Even if not, they have entered a Spanish port and are subject to the laws of that country. If in service to the French, since France and Spain are allies, should obey the Spanish command. Invokes principle of justice governing relations between friendly countries. Will inform Congress on the subject. Assurance that men will not be punished but only obliged to fulfill engagement. Will never sacrifice anyone to political expedience but not the case here, rather the rights of a friendly sovereign.
